General Terms and Conditions(GTC)

§ 1 Scope of Application

(1) These General Terms and Conditions of Sale (hereinafter: GTC) apply to all contracts concluded via our online shop between us, company SAMP EVENTS UG (hereinafter ‘we’ or us’) and you as our customer (hereinafter: "Customer" or "you"). The GTC apply regardless of whether you are a consumer, entrepreneur or merchant. The version of the GTC valid at the time of conclusion of the contract shall apply.

(2) We do not accept any deviating terms and conditions of the customer. This also applies if we do not expressly object to their inclusion.

(3) The customer is a consumer insofar as the purpose of the ordered deliveries and services cannot be attributed predominantly to his commercial or self-employed professional activity. On the other hand, an entrepreneur is any natural person or legal entity or partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding the contract.

§ 2 Conclusion of Contract

(1) The presentation and advertising of items in our online shop do not constitute a binding offer to conclude a purchase contract.

(2) You can select products from our range, in particular Samp Events, and collect them in a so-called shopping basket via the button "add to shopping basket". By clicking on the button "order with obligation to pay" you submit a binding application to purchase the goods in the shopping cart. Before submitting the order, you can change and view the data at any time. However, the application can only be submitted and transmitted if you have accepted these contractual terms and conditions by clicking on the "Accept GTC" button and have thereby included them in your application.

(3) We will then send you an automatic confirmation of receipt by e-mail in which your order is listed again and which you can print out using the "Print" function. The automatic acknowledgement of receipt merely documents that we have received your order and does not constitute acceptance of the application. The contract is only concluded when we issue a declaration of acceptance, which is sent in a separate e-mail (order confirmation). In this e-mail or in a separate e-mail, but at the latest upon delivery of the goods, the text of the contract (consisting of the order, GTC and order confirmation) will be sent to you by us on a durable data medium (e-mail or paper printout) (contract confirmation). The text of the contract will be stored in compliance with data protection laws.

(4) We can only consider orders for deliveries abroad with a minimum order value. You can find the minimum order value in the price information provided in our online shop.

(5) The contract shall be concluded in English.

§ 3 Terms of Delivery

* We are entitled to make partial deliveries insofar as this is reasonable for you.

* Delivery times stated by us are calculated from the time of our order confirmation, subject to prior payment of the purchase price (except in the case of purchase on account). If no delivery time is specified in our online shop, it shall be 7 days.

* If no copies of the selected product are available at the time of your order, we will inform you immediately in the order confirmation. If permanently unavailable, a contract is not concluded.

* If the product is temporarily unavailable, we will also inform you immediately in the order confirmation.

* Delivery restrictions apply: we only deliver to customers with habitual residence and a delivery address in the following countries: German.

§ 4 Prices and Shipping Costs

* All prices in our online shop are gross prices, including VAT, but excluding shipping costs.

* Shipping costs are indicated in our online shop and displayed before order submission.

* For partial deliveries, shipping costs apply only to the first delivery unless requested otherwise by the customer.

* If you revoke your order, you may demand reimbursement of delivery costs under statutory conditions.

* Goods are dispatched by post. If you are a consumer, we bear the shipping risk.

* For order revocation, you bear the direct costs of return shipment.

§ 5 Terms of Payment

* You can pay by invoice, credit card, direct debit, or PayPal. Payment by invoice is also available upon request.

* You can update your saved payment method in your user account anytime.

* Payment is due immediately upon contract conclusion. Missing the deadline incurs a default interest rate of 5% above the base rate.

* Default interest does not preclude claims for further damages caused by default.

§ 6 Retention of Title

The delivered goods remain our property until the purchase price has been fully paid.

§ 7 Warranty

* We are liable for material or title defects under statutory provisions, particularly §§ 434 et seq. BGB.

* The limitation period for consumer claims is two years from delivery. For entrepreneurs, it is 12 months.

* Seller or manufacturer warranties are additional and detailed in enclosed warranty conditions.

* In Case of event cancellation before 24 hours we are obliged to pay 100% refund to you.

§ 8 Liability

Limitation of Liability: SAMP EVENTS UG is not responsible for any personal injury, death, loss, or damage to property that occurs during or after the Event. To the maximum extent permitted by law, our liability is limited to the total value of your ticket purchase.

* For material obligations breached by negligence, liability is limited to foreseeable damage typical for the contract.

* Liability exclusions also apply to representatives and agents unless fraudulent intent or guaranteed quality is involved.

* In case of any damage to property by at event location, you are obliged to pay the full amount of the damaged product.

* The Product Liability Act provisions remain unaffected.

* By attending the Event, you acknowledge that there may be inherent risks, including but not limited to personal injury, loss, or damage to property. You voluntarily assume all risks associated with participation in the Event.

* For your personal belongings we are not responsible to take care before, during or after the event. We suggest not to bring any valuable to our events.

Indemnity: You agree to indemnify and hold harmless SAMP EVENTS UG, its employees, agents, and contractors against any claims, losses, damages, liabilities, or expenses arising from your participation in the Event.

§ 9 Data Protection

You can find detailed information on data protection with us, in particular on the scope of the processing of your data and your legal rights, in our data protection declaration under SAMP EVENTS UG.

§ 10 Statutory Right of Withdrawal/Cancellations for Consumers

Right of withdrawal:

Refund requests must be made in writing within 7 days of your ticket purchase. Refunds may be issued according to the following conditions:

* Full refund for cancellations made before 7 days of event.

* 70% refund for cancellations made within 6 to 1 day before the event date.

* No refund will be issued if you cancel within 24 hours of the Event date or fail to attend.

In order to exercise your right of withdrawal, you must inform us, via email, of your decision to withdraw from this contract by means of a clear declaration (e.g., a letter or email). You can use the attached model withdrawal form for this purpose, but it is not mandatory.

Event Cancellation/Postponement: If the Event is canceled or postponed by us, you will be notified promptly. You will be entitled to a full refund or the option to transfer your ticket to a rescheduled date, as per your preference.

Force Majeure: SAMP EVENTS UG is not liable for any refunds or compensation in case of event cancellation due to reasons beyond our control, such as natural disasters, strikes, pandemics, or other unforeseeable circumstances.

Consequences of revocation:

If you withdraw from this contract, we must repay you all payments that we have received from you, including delivery costs (with the exception of additional costs for non-standard delivery), without delay and at the latest within fourteen days.

Exceptions to the right of withdrawal:

The right of withdrawal does not apply to the following contracts:

* Contracts for goods not prefabricated or tailored to personal needs.

* Contracts for perishable goods or those nearing expiration.

* Contracts for sealed goods unsuitable for return due to health or hygiene reasons.

* Contracts for goods inseparably mixed with others after delivery.

* Contracts for alcohol where the price fluctuates with market changes.

* Contracts for sealed software or recordings with broken seals.

* Contracts for non-subscription newspapers or periodicals.

§ 11 Codes/Consents of Conduct

Consent for Media Use: By purchasing a ticket, you consent to being photographed, filmed, or recorded during the Event. These images and recordings may be used for promotional, marketing, or other purposes related to SAMP EVENTS UG’s activities.

Exclusion from Media: If you do not wish to be included in Event media, please notify Event staff prior to or upon arrival.

Respectful Conduct: All attendees are expected to conduct themselves in a respectful and professional manner. This includes being considerate of others' opinions, backgrounds, and experiences. Harassment, bullying, or discriminatory behavior based on race, gender, sexual orientation, religion, nationality, disability, or any other characteristic will not be tolerated.

Disruptive Behavior: Any behavior that disrupts the Event, such as yelling, excessive noise, or intentionally interfering with the speaker, performers, or other attendees, is prohibited. Attendees should not engage in disruptive conversations or activities that prevent others from fully enjoying the Event.

Substance Use: The use of illegal substances, alcohol (unless permitted by the venue), or any intoxicants during the Event is strictly prohibited. Anyone found under the influence of drugs or alcohol may be removed from the Event immediately without refund.

Respect for Venue Property: Attendees are responsible for treating the Event venue and its property with respect. This includes not damaging or defacing any property, equipment, or decor. Any damages caused by an attendee will be subject to reimbursement.

Personal Space and Privacy: Please be mindful of personal space and privacy. Refrain from excessive physical contact with other attendees unless you have received consent. Photographs and videos should be taken only with respect for others’ privacy, and consent should be sought if necessary.

Respect for Speakers and Performers: You are expected to show respect for all speakers, performers, and event staff. Disrupting or disrespecting individuals during their presentations or performances will result in immediate removal from the Event.

No Aggressive or Violent Behavior: Any form of verbal or physical aggression, intimidation, or threats towards other attendees, staff, or vendors is prohibited. This includes, but is not limited to, fighting, arguing, or making threatening gestures. Such actions will result in immediate ejection from the Event, and possible legal consequences.

Compliance with Event Staff and Security: Attendees must follow the instructions of Event staff and security personnel. Event staff and security have the authority to remove anyone who fails to comply with the Event’s Code of Conduct or poses a threat to the safety and enjoyment of others.

Dress Code: Attendees must wear appropriate clothing at all times. Attire that is considered offensive, obscene, or inappropriate may result in refusal of entry to the Event or removal from the venue.

Age Restrictions: If the Event has age restrictions (e.g., "18+" or "family-friendly"), attendees must adhere to those guidelines. Parents or guardians are responsible for the behavior of their children at the Event.

Unacceptable Content: Attendees must not bring or display offensive, threatening, or inappropriate content at the Event. This includes signage, clothing, or personal items that may cause distress or harm to other participants. Any content deemed offensive or harmful by Event organizers will be prohibited.

Inappropriate Language: Offensive or inappropriate language, including hate speech, slurs, or any form of discriminatory remarks, is not acceptable. Attendees should refrain from using such language in any form (spoken, written, or in gestures).

Event-Specific Rules: Some events may have additional specific conduct guidelines. These will be provided before or at the start of the Event, and you are required to follow them to ensure a positive experience for all participants.

§ 12 European Dispute Resolution for Consumers

Pursuant to Art. 14 (1) ODR Regulation, the European Commission provides a platform for online dispute resolution (ODR), accessible at http://ec.europa.eu/consumers/odr/. This allows out-of-court settlement of consumer disputes arising from online contracts.

We are not willing or obliged to participate in a dispute resolution procedure before a consumer arbitration board.

§ 13 Applicable Law and Place of Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer residing in another country, mandatory legal provisions of your country remain unaffected.
